Goldcar – Disputed EUR 500 cross-border penalty and potentially unfair consumer practices
I would like to report my experience with Goldcar, following a car rental in Italy, and raise concerns about what I believe may be a misleading and potentially unfair business practice affecting consumers.
What happened?
In October 2026, I rented a car from Goldcar at Milan Malpensa Airport. During a journey from Milan towards Como, where I was staying in San Mamete, my navigation system inadvertently directed me across the Swiss border. I drove through Switzerland for approximately 30 minutes before returning to Italy.
The border crossing was entirely accidental. I had no intention of visiting Switzerland and was unaware that the suggested route would take me across the border (it's Schengen area). I did not deliberately breach the rental agreement or attempt to circumvent Goldcar's rules.
After discovering what had happened, I contacted Goldcar's customer service to clarify the situation. I was explicitly informed that I would not be charged a penalty. I relied on this assurance in good faith.
However, Goldcar subsequently informed me that crossing the Swiss border without purchasing the required additional cross-border option constituted a breach of its rental conditions and that an administrative charge of approximately EUR 500 could be imposed.
I find this particularly concerning for several reasons.
1. A EUR 500 charge for a brief and unintentional border crossing
The journey through Switzerland lasted approximately 30 minutes and was entirely accidental. Nevertheless, Goldcar appears prepared to impose a charge of approximately EUR 500.
I question whether such a substantial administrative charge is proportionate to the circumstances and whether its legal and contractual basis is sufficiently transparent to consumers.
2. The vehicle already had a valid Swiss motorway vignette
After investigating the matter, I discovered that the rented vehicle was equipped with a valid Swiss motorway vignette, valid until January 2027.
This raises important questions about Goldcar's cross-border policy and the information provided to customers.
Why was I not clearly informed about the possibility of purchasing an additional cross-border option for a relatively small fee? This is 431% more!
It is particularly concerning that a company may fail to adequately inform customers about such an option while subsequently imposing a charge of approximately EUR 500 for crossing the border.
The financial discrepancy between the cost of an additional option and the penalty is substantial. I cannot rule out the possibility that such a business model is significantly more profitable for Goldcar than ensuring that customers are properly informed and offered the opportunity to purchase the relevant option.
I acknowledge that the presence of a Swiss motorway vignette does not automatically mean that the vehicle was authorised to cross the border under the rental agreement. Nevertheless, this fact deserves clarification.
3. Contradictory information from Goldcar
Another serious concern is the contradiction between Goldcar's customer service communication and its subsequent position.
I was initially assured that no penalty would be imposed. Subsequently, the company referred to its terms and conditions to justify the potential EUR 500 charge.
I believe consumers should be entitled to rely on information explicitly provided by a company's customer service representatives, particularly when seeking clarification about an incident.
Why I am reporting this to Altroconsumo
I would like Altroconsumo to examine whether Goldcar's practices may constitute misleading or unfair commercial practices under applicable consumer protection legislation.
In particular, I believe the following issues deserve attention:
- Whether customers are adequately informed about cross-border restrictions and the possibility of purchasing additional authorisation.
- Whether a charge of approximately EUR 500 for an inadvertent border crossing is legally justified and proportionate.
- Whether Goldcar's customer service assurances can be disregarded when the company subsequently seeks to impose a financial penalty.
- Whether the difference between the relatively low cost of additional cross-border cover and the substantial penalty may create an incentive for insufficiently transparent customer information.
I am concerned that this may not be an isolated issue but potentially a broader practice affecting other Goldcar customers, particularly tourists renting cars in Italy and travelling near international borders.
What I expect
I would appreciate Altroconsumo's assessment of this case and, if appropriate, its intervention with Goldcar or referral to the competent Italian consumer protection authority (see the same case from 2025).
I also hope that this complaint may help other consumers avoid similar situations and encourage greater transparency in the car rental industry.
I can provide the rental agreement, Goldcar's terms and conditions, the complete correspondence with customer service, and photographic evidence of the vehicle's Swiss motorway vignette.
In my opinion, consumers should not be exposed to unexpected charges of hundreds of euros when they have not been properly informed about the available options and applicable restrictions.
Thank you for your attention.
