Spett.le Centauro Rent A Car), Il sottoscritto Davide Serio (tel. +393383006868, email: davideserio@gmail.com), con la presente formula formale formale atto di diffida e messa in mora ai sensi e per gli effetti dell’art. 1218 del Codice Civile italiano, in relazione ai gravissimi fatti occorsi in data 23 giugno 2026 presso la stazione di noleggio CENTAURO RENT A CAR di via del Riposo 18, 80100 Napoli. FATTI In data antecedente, il sottoscritto provvedeva a prenotare e saldare tramite la Vostra piattaforma il noleggio di un’autovettura (Gruppo Skoda Kamiq o simile) per il periodo dal 23 giugno 2026 al 29 giugno 2026 (Codice Prenotazione: DYI-211449940), per un corrispettivo di € 137,02. Presentatosi sul luogo di consegna, munito di regolare documentazione e gravato da bagagli, il personale della stazione di noleggio Centauro si rifiutava categoricamente di adempiere alla prestazione e di consegnare l'autovettura. La motivazione addotta consisteva nell'assenza di un biglietto aereo cartaceo o digitale esibito dal conducente. Si evidenzia che tale clausola/condizione ostativa non era in alcun modo presente nelle condizioni principali di prenotazione fornite da DoYouItaly, né segnalata in fase di checkout. Al contrario, la documentazione contrattuale in possesso del cliente specificava esclusivamente che l’assenza di un vettore aereo avrebbe comportato l'addebito della franchigia, e non il diniego assoluto della prestazione contrattuale. I tentativi di ricevere assistenza immediata tramite il Vostro canale telefonico internazionale si rivelavano vani e dispendiosi, risolvendosi nell'interazione con un risponditore automatizzato non abilitato alla gestione dell'emergenza. Al fine di evitare la perdita totale della vacanza e dei servizi alberghieri già saldati, e in evidente stato di alterazione psicofisica indotta dal Vostro inadempimento, il sottoscritto si vedeva costretto a effettuare d’urgenza, tramite dispositivo mobile, nuove prenotazioni sulla Vostra stessa piattaforma per ovviare al blocco. Dopo una prima prenotazione contenente un errore materiale di data dovuto allo stato d'ansia, veniva finalizzata la prenotazione DYI-213190489 per un costo di € 160,14. PROFILI GIURIDICI E RESPONSABILITÀ Il comportamento descritto integra una palese violazione degli obblighi di correttezza ed esecuzione del contratto secondo buona fede (art. 1375 c.c.), nonché una condotta contraria ai doveri di trasparenza e adeguatezza informativa sanciti dal Decreto Legislativo n. 206/2005 (Codice del Consumo italiani ed equivalenti europei). Il rifiuto ingiustificato di consegnare il bene prenotato costituisce un inadempimento contrattuale radicale (art. 1218 c.c.), del quale la Vostra società risponde direttamente nei confronti del consumatore per aver trasmesso informazioni ingannevoli, incomplete o difformi dalle reali condizioni applicate dal fornitore locale. La condotta da Voi tenuta ha innescato un effetto domino patrimoniale e non patrimoniale (danno da vacanza rovinata) interamente riconducibile alla Vostra originaria omissione. RICHIESTE E ADEMPIMENTI Tutto ciò premesso, il sottoscritto RICHIEDE E INTIMA a DoYouItaly, in solido con il fornitore materiale Centauro Rent a Car per quanto di rispettiva competenza: 1. Il rimborso immediato ed integrale della prima prenotazione non fruita per Vostro esclusivo fatto e colpa (DYI-211449940) pari a € 137,02; 2. Il rimborso/risarcimento contrattuale della somma corrisposta per la successiva prenotazione (DYI-213190489) pari a € 160,14, richiesta a titolo di ristoro provvisorio per i maggiori esborsi, i costi telefonici e il danno morale patito a causa del disservizio. Le suddette somme, per un totale di € 297,16, dovranno essere riaccreditate sullo stesso metodo di pagamento utilizzato in fase di prenotazione entro e non oltre 7 (sette) giorni dal ricevimento della presente. CON AVVISO CHE In difetto di tempestivo riscontro e di integrale soddisfacimento delle legittime richieste sopra esposte, il sottoscritto non esiterà a conferire mandato al proprio legale per adire le vie giudiziarie competenti (ivi comprese le procedure di mediazione/conciliazione telematica previste per le controversie dei consumatori), con riserva di richiedere in quella sede il risarcimento di tutti i danni patrimoniali accessori, dei costi legali e del danno non patrimoniale da vacanza rovinata. Please be advised that the rental terms and conditions for your original booking, explicitly state under the supplier requirements that a valid boarding pass and proof of a return flight must be presented when collecting the car. The terms further clarify that if a debit card is provided, the local supplier will charge the full excess amount as a deposit instead of just blocking it. The local company acted in accordance with these contractual terms, which were available to you during the booking process. Furthermore, according to our cancellation policy, a refund for a prepaid reservation can only be processed if the booking is cancelled prior to the scheduled start date and time via the link provided on our website. As the collection dates for both reservations have already passed, they are classified as non-collections or no-shows, making them strictly non-refundable. Consequently, we are unable to process a refund or compensation for either booking or for any additional travel expenses incurred. Subject: FORMAL COMPLAINT AND NOTICE OF DEFAULT – Response to your email dated 26/06/2026 – Booking Refs: DYI-211449940 and DYI-213190489 To the attention of Andreea and the DoYouItaly Complaints Department, I am writing in response to your email dated June 26, 2026. The justification provided for denying my refund is based on a blatantly incorrect, partial, and arbitrary reading of your own Terms and Conditions. I strongly urge you to carefully review the Confirmation Voucher you issued for booking DYI-211449940. 1. On the alleged legitimacy of the refusal to deliver the vehicle You state that the local supplier acted in accordance with the contractual terms by denying the vehicle due to the absence of a boarding pass. This is factually false. Under the "Driver Requirements" (Requisiti del conducente) section of your Voucher, it explicitly states: "Please note that to collect the car you will need to present a valid boarding pass and proof of a return flight. Otherwise, the excess amount will be charged as a deposit." Nowhere in the contract is it stipulated that the absence of a flight ticket results in the cancellation of the booking or the absolute denial of the service. The only contractual condition provided was the charging of the excess amount as a deposit—a procedure that the Centauro staff categorically refused to apply, arbitrarily preventing me from collecting the vehicle. This constitutes a severe breach of contract (non-performance) by your supplier. 2. On the inapplicability of the "Cancellation Policy" and "No-Show" classification You classify the event as a "no-show" or "non-collection," arguing that I should have cancelled the booking prior to the scheduled start time. This argument is legally and logically unfounded. I duly presented myself at the rental desk at 12:00 PM on 23/06/2026 (the exact scheduled start time). The disservice and the unlawful refusal by Centauro occurred precisely at that moment. This is not a "voluntary cancellation" or a "failure to collect" on my part, but rather a refusal of performance by the rental company. Consequently, demanding that I cancel a reservation online before 12:00 PM due to a third party's breach of contract discovered at 12:00 PM is an unreasonable, unforeseeable, and unenforceable request. FINAL DEMAND The documentary evidence proves beyond any reasonable doubt that the car was denied to me in direct violation of your own contractual clauses. Therefore, I hereby renew my formal demand for: The immediate and full refund of booking DYI-211449940 (€137.02) for services not rendered due to the supplier's breach of contract. The refund of the corrective emergency booking DYI-213190489 (€160.14) as compensation for the direct damages and financial loss caused by your failure to provide the agreed service. Should I not receive a full refund of €297.16 to my original payment method within 5 working days, this correspondence and your Confirmation Voucher will be submitted to the competent European Consumer Centres (ECC-Net) and to my legal counsel to initiate legal proceedings. In such an event, I will seek compensation for all material damages, additional expenses incurred, and non-patrimonial damages for the ruined holiday. Further to our previous correspondence regarding the unresolved dispute and the established breach of contract concerning bookings DYI-211449940 and DYI-213190489, please be advised that I have instructed my legal counsel to proceed with a formal claim for compensation and damages. In order to ensure the proper and lawful service of legal documents and the formal notice of default, I hereby formally request that you provide me with the following official contact information for your respective companies: Registered Postal Address: The official physical address of your corporate headquarters and/or your legal representation in Italy, valid for receiving registered mail and legal notices. Certified Email Address (PEC): Your registered Posta Elettronica Certificata (PEC), mandatory for companies operating in Italy. Legal Department Email: If a PEC is not applicable to your corporate structure under EU law, please provide the direct and official email address of your Legal Department or the appointed legal representative authorized to receive pre-litigation claims. This information is requested to ensure transparency and to allow my appointed lawyers to formally serve the claim for material and non-patrimonial damages arising from your failure to perform the contracted services. I am writing to follow up on your previous communications, in which you rejected my refund request by baselessly and hypothetically alleging that the vehicle was not delivered to me due to a "no-show" on my part or a failed attempt to charge the security deposit at the rental desk. These unfounded assumptions have just been categorically disproven by documentary evidence from your own local supplier. Attached to this email, please find the official written communication I have just received from Centauro Rent a Car, signed by their agent Marta (Contact Centre), which explicitly states the following: "Please be informed that it was not possible to proceed with the rental because, according to our Terms & Conditions, the presentation of a return flight ticket is required." This communication constitutes irrefutable proof that: 1. I duly presented myself at the rental desk (there was absolutely no "no-show"). 2. Your supplier refused the rental by enforcing its own internal policy, deliberately ignoring the alternative clause that you yourselves included in the official Voucher DYI-211449940 ("Otherwise, the excess amount will be charged as a deposit"). 3. Centauro never made any attempt to charge a deposit to my credit card, denying me the service outright. Your supplier has blatantly breached the agreed contractual terms. Since you, acting as the broker, are jointly and severally liable for the actions of your supplier network, your continued withholding of my funds constitutes a civil wrong and a severely unfair commercial practice. In light of this definitive documentary evidence, I HEREBY FORMALLY DEMAND AND PUT YOU ON NOTICE to process a bank transfer in my favor for the total sum of € 547.16, no later than the strict deadline of 5 (five) working days from the receipt of this email. This amount is calculated and justified as follows: • € 137.02 as a full refund for booking DYI-211449940 (service never rendered due to the supplier's breach of contract). • € 160.14 as compensation for actual damages / direct financial loss (cost of the second emergency booking, DYI-213190489, necessitated by your failure to provide the service). • € 250.00 as fixed compensation for non-material damages (distress, ruined holiday, time lost at the airport, time taken away from my professional activities, and the burden of managing this dispute caused by your obstructionism and initial bad faith). Please be strictly advised that: Should I fail to receive full payment within the aforementioned deadline, I will consider all amicable negotiations terminated. This formal notice, along with Centauro's written confession, will be immediately filed with the competent Giudice di Pace (Justice of the Peace) under the Italian Consumer Code jurisdiction to obtain a payment injunction, with all legal costs to be borne exclusively by you. Concurrently, I will file a formal complaint for Unfair Commercial Practices with the Italian Competition Authority (AGCM) and the European Consumer Centre (ECC-Net). In the interest of reaching a prompt, amicable, and definitive resolution without escalating the dispute to the regulatory authorities (AGCM / ECC-Net) or pursuing judicial recovery, I am submitting the following final settlement counter-offer: I am willing to accept the credit note resolution and officially waive all remaining claims (including the additional claim for € 250.00 in non-material damages/distress), subject to a fair compromise regarding the financial loss sustained. I believe there has been a severe misunderstanding or your customer service team has failed to read my previous email carefully. I DID NOT confirm or accept your offer for a credit note of €133.93. My previous email was a conditional counter-offer. I explicitly stated that I would accept a credit note resolution strictly on the condition that it covers the sum of € 217.09 (which includes the original booking and 50% of the secondary emergency booking caused by your supplier's documented breach of contract). Furthermore, I note a discrepancy in your figures, as the original booking DYI-211449940 was € 137.02, not € 133.93. Therefore, under contract law, there is no mutual agreement (meeting of the minds). Please be formally advised that: I categorically REJECT the credit note for € 133.93. Do not send me any link, as I will not use it. If you are unable or unwilling to read and accept my settlement counter-offer of € 217.09, then my settlement proposal is officially withdrawn. The credit note has therefore been issued accordingly for booking DYI-211449940. Our decision regarding booking DYI-213190489 remains unchanged, and we consider this matter closed.
