Dear Il Lanificio,
On 08 December 2025, I purchased a Virgin Wool Slim Fit Single-Breasted Suit with Peak Lapel – Charcoal Grey (Order No. 49473) from your online store for the total amount of €415.00.
Following the order confirmation, I did not receive any shipping confirmation or tracking number. Despite several attempts to contact you via WhatsApp, email, and other available communication channels, I received no response.
Only after sending a formal letter by post did I receive a reply from you, more than two months after the order date. In your response, you provided a tracking number and stated that the shipment had allegedly been delivered on 23 December 2025. This is not possible, as I was not present in the country of delivery at that time. I am in possession of evidence confirming this and am prepared to provide it if necessary.
Furthermore, pursuant to Clause 4.4 of your General Terms and Conditions, the customer is required, at the moment of delivery, to verify the integrity of the package and to note any irregularities on the courier’s delivery document. This clause clearly presupposes that the goods are physically handed over to the customer at the time of delivery. In the present case, no delivery took place, I was not present, and I did not sign any delivery document. Consequently, the situation described in Clause 4.4 never occurred, which further confirms that the contractual obligation of delivery has not been fulfilled.
Given that more than two months have passed since the conclusion of the contract and that the goods have not been received, I no longer wish to proceed with this order. I therefore formally request a full refund.
Please provide written confirmation and process the refund within 15 days of receipt of this letter. Failing this, I will take further legal steps without additional notice.
This letter constitutes formal notice pursuant to Article 1219 of the Italian Civil Code.
