Subject: Formal Dispute of Claim Rejection & Demand for Compensation – Delay at Final Destination due to Missed Connection – Booking Ref (PNR): [ZSBJJD] – Flights [AC838] and [EN8810] on [13/08/2026 and 14/08/2026]
Dear Air Canada Team,
I am writing to formally contest the rejection of my claim (Ref: [CAS-11354778-D1Y4H7]) regarding the flight itinerary from Vancouver (YVR) to Milan Malpensa (MXP) via Frankfurt (FRA) on [13/08/2026 and 14/08/2026], booked under a single ticket (PNR: [ZSBJJD]).
The initial leg of the itinerary, flight [AC838] operated by Air Canada from Vancouver to Frankfurt, suffered a delay that resulted in a missed connection in Frankfurt. As a consequence, I was rebooked on a later connecting flight to Milan Malpensa (flight [EN8810] operated by Air Dolomiti). Due to this missed connection, I reached my final destination (Milan Malpensa) at [2.35 P.M] – accumulating a total delay of approximately 4 hours at the final destination compared to the original itinerary.
In your previous correspondence, you denied compensation citing generic "safety-related issues" due to "unforeseen maintenance". I strictly dispute this position.
According to the legal precedent set by the Canadian Transportation Agency (CTA), a carrier cannot simply rely on generic statements regarding safety or maintenance to exempt itself from liability. Air Canada holds the burden of proof and must provide explicit technical records proving that the mechanical failure was extraordinary, completely unpredictable, and unpreventable through standard maintenance procedures.
As this single-ticket itinerary originated in Canada and was operated by a large carrier, I hereby request the statutory compensation of 400 CAD (or equivalent in EUR) pursuant to the Air Passenger Protection Regulations (APPR) for a final arrival delay between 3 and 6 hours.
Please process the payout to the original payment method within 15 days of receiving this notice.
Failure to resolve this issue or provide concrete technical proof justifying the delay will result in an immediate formal complaint lodged with the Canadian Transportation Agency (CTA) for administrative review and enforcement.
