Ho provveduto autonomamente a inviare formale Messa in Mora via PEC a Etihad. Allego la Ricevuta di Avvenuta Consegna che ha pieno valore legale. La controparte è ufficialmente notificata.

SUBJECT: URGENT // FORMAL NOTICE OF BREACH OF CONTRACT & ILLEGITIMATE
"ADD & COLLECT" DEMAND
Dear Legal Counsel and Guest Relations Team,
I am writing to formally demand the immediate resolution regarding my flight ticket (PNR:
9SN9HQ). Your current refusal to honor the written fare rules and the demand for a payment of
€680.00 to reschedule the return flight are mathematically and legally baseless, constituting a
breach of contract and an unfair commercial practice under EU and International Consumer
Law.
1. THE FACTS AND IRREFUTABLE EVIDENCE
My claim is supported by four specific pieces of written evidence generated by your own
systems/agents, which contradict your current position:
● EVIDENCE A: TICKET VALIDITY CONFIRMED UNTIL SEPT 2026 Current agents
claim the ticket is expired. This is false. In the chat transcript dated Jan 7, 2026, your
agent Mahmoud explicitly confirmed in writing: "We will do it manually for you as the
ticket is valid until 28th September 2026". (See Attachment 2)
● EVIDENCE B: FARE RULES CONFIRMED AS "DELUXE" (NO PENALTY) On Jan 27,
2026, your Guest Relations Officer (Marta) confirmed via email that the remaining
segment is "Economy Deluxe" and explicitly stated: "change penalty is not applied".
(See Attachment 1)
● EVIDENCE C: PROOF OF BAD FAITH PRICING (THE €151 vs €680
CONTRADICTION) I have documented proof of contradictory quotes for the same
change request:
○ Quote 1 (Honest): Your agent offered a change for a total of €151.00 (€150
penalty + €1 fare diff), as shown in chat logs.
○ Quote 2 (Current/Illegitimate): Your supervisors are now demanding €680.00.
The existence of the €151.00 quote proves that the current €680.00 demand is
arbitrary. (See Attachment 3)
● EVIDENCE D: OBSTRUCTION OF RIGHTS ("EY LEGAL" FLAG) Screenshots prove
my case (2601255116467) is flagged internally as "Ticket change EY LEGAL" and the
content is hidden ("No records to display"), denying me access to my own administrative
file. (See Attachment 4)
2. THE LEGAL VIOLATION: "DOUBLE TAXATION"
The demand for €680.00 to change a date on a partially flown ticket (total original cost €837.85)
is illegitimate because it implies the repricing of the flown outbound sector. Since the
outbound sector has already been flown and paid for, demanding the payment of airport taxes
again for that sector constitutes Unjust Enrichment (Arricchimento senza causa) and "Double
Taxation".
3. FORMAL DEMAND (ULTIMATUM)
Since I have not yet purchased a new ticket, I offer you one final opportunity to resolve this
amicably. I require one of the following actions within 48 hours:
● OPTION A (Specific Performance - PREFERRED): Immediately reissue my return
flight to [25th April 2026 or 26th April 2026] applying the confirmed "Deluxe" rules. You
must charge ONLY the fare difference on the return segment (calculated against the
original fare component), without re-taxing the flown sector.
● OPTION B (Termination & Refund): If you refuse to honor the "Deluxe" conditions, I
demand the FULL REFUND of the value of the unused "Economy Deluxe" segment to
my original form of payment immediately, so I can purchase a new ticket with another
carrier.
WARNING: Failure to respond within 48 hours will leave me no choice but to purchase a new
ticket at my own expense and sue Etihad for the full cost plus damages through Altroconsumo
and file a formal report with the AGCM for unfair commercial practices.
Sincerely,
Stefano Di Pierro
