English translation follows Spett.le HONG KONG PIXEL NETWORK TECHNOLOGY CO., LIMITED, con la presente desidero segnalare un addebito non autorizzato relativo a un vostro servizio. In data 05/02/2026 ho usufruito di un servizio di conversione file dal vostro sito (https://www.toppdf.co) inviatomi regolarmente e come richiesto all’indirizzo e-mail marco.marianelli@hotmail.it, corrispondendo l’importo di € 0,10. Tuttavia, in data 06/02/2026 mi è stato addebitato un importo pari a € 49,90 (codice transazione id 46029959YG314581T) per un presunto abbonamento automatico, che non risulta da me richiesto né autorizzato. Preciso di non aver sottoscritto alcun contratto o consenso a servizi in abbonamento. Rilevo che le modalità di attivazione dell’abbonamento non risultavano conformi alla normativa vigente in materia di tutela del consumatore e contratti a distanza. In particolare: - Il meccanismo di conferma non riportava una dicitura chiara ed inequivocabile quale “abbonati a pagamento” o “attiva a pagamento”, idonea a rendere evidente l’assunzione di un obbligo economico e di una trattenuta economica. - Le condizioni relative al rinnovo automatico non risultavano esposte in modo chiaro, immediato e trasparente prima della conclusione del contratto, ma collocate in posizione secondaria rispetto alle opzioni di pagamento, con conseguente rischio di errore per il consumatore. - Non risulta essere stato fornito adeguato preavviso in merito ai rinnovi automatici. - Non ho ricevuto comunicazione chiara e completa via e-mail contenente il riepilogo delle condizioni contrattuali e le modalità di recesso. Alla luce di quanto sopra, contesto formalmente la legittimità del rinnovo automatico sopra indicato e CHIEDO il rimborso integrale della somma di € 49,90 indebitamente addebitata, entro e non oltre 14 giorni dal ricevimento della presente tramite bonifico bancario intestato a Marco Marianelli sul seguente IBAN: IT27A0306939490100000004208 In difetto di riscontro positivo entro tale termine, mi vedrò costretto/a ad adire le competenti Autorità per la tutela dei miei diritti, ivi compresa l’Autorità Garante della Concorrenza e del Mercato e gli organismi di tutela dei consumatori. On February 5, 2026, I used a PDF file conversion service from your website (https://www.toppdf.co) that was sent to me regularly and as requested to the email address marco.marianelli@hotmail.it, for a fee of €0.10. However, on February 6, 2026, I was charged €49.90 (transaction code 46029959YG314581T) for a supposed automatic subscription, which I did not request or authorize. I hereby clarify that I have not signed any contract or agreed to any subscription services. I note that the subscription activation procedures did not comply with current legislation on consumer protection and distance contracts. Specifically: - The confirmation mechanism did not include clear and unambiguous wording such as "paid subscribers" or "activate for a fee," which would clearly indicate the assumption of a financial obligation and a withholding fee. - The terms and conditions relating to automatic renewal were not clearly, immediately, and transparently presented before the contract was concluded. Instead, they were placed secondary to the payment options, resulting in a risk of error for the consumer. - Adequate advance notice regarding automatic renewals does not appear to have been provided. - I did not receive clear and complete communication via email containing a summary of the contractual terms and conditions and the cancellation policy. In light of the above, I formally contest the legitimacy of the automatic renewal indicated above and REQUEST a full refund of the €49.90 unduly charged, no later than 14 days after receipt of this letter, via bank transfer to Marco Marianelli using the following IBAN: IT27A0306939490100000004208 Failure to respond within this timeframe will force me to take legal action against my rights, including the Italian Competition Authority and consumer protection bodies. Dear Customer Service Team, I acknowledge your response and I am aware that the subscription has now been cancelled. However, I must firmly reiterate that the subscription in question was activated without my informed consent. As already stated in my previous communication, the activation process did not comply with the fundamental transparency requirements set out in consumer protection and distance selling regulations. In particular, the alleged “trial” leading to a paid PRO subscription was not presented in a clear, explicit, and unambiguous manner prior to the payment confirmation. The absence of a clear indication of a binding financial obligation and the lack of properly highlighted automatic renewal terms invalidate any claim of valid consent on my part. Therefore, I formally dispute the legitimacy of the charge of €49.90 (transaction ID: 46029959YG314581T), as it was applied without proper authorization. In light of the above, I hereby demand a full refund of the amount of €49.90, which was unduly charged. I expect this refund to be processed within 14 days from receipt of this email. Failing this, I will proceed with formal actions, including filing a complaint with the relevant consumer protection authorities. I look forward to your prompt resolution of this matter.
