Spett.le RyanairIn data 07/08/2023 ho prenotato (n° prenotazione JMWH7H) per mio figlio Simone Nebbia, in partenza per l’Erasmus, il volo n° FR5898 da Torino a Madrid per il giorno 28/08/2023 con partenza alle ore 20:25.Il giorno della partenza Lunedì 28/08/2023 alle ore 19:43, quindi meno di un’ora prima della partenza, è arrivata email di cancellazione del volo, senza spiegazioni. Faccio notare che alle 20:35 dallo stesso aeroporto di Torino Caselle è partito per Madrid un volo di Iberia, quindi non possono esserci stati motivi legati alle condizioni meteorologiche avverse.La possibilità di modificare il biglietto è stata inutile (posti voli successivi già esauriti nella fase di modifica biglietto, ma acquistabili dal sito!!!!!).Abbiamo quindi acquistato volo con Iberia per il giorno 30/08/2023.Con la presente richiedo pertanto la corresponsione dell’indennizzo previsto ai sensi dell’art. 7, Reg. UE n.261/04 (euro 250,00), oltre al rimborso del costo del biglietto inutilizzato (euro 85,13). Chiedo anche indennizzo del costo del Taxi già prenotato e pagato in attesa a Madrid (euro 26,78) e dell’albergo prenotato e pagato a Madrid (euro 63,65). CPTIT01864452-15Dear Sir/Madam,We refer to your correspondence, dated 29/8/2023.We sincerely regret the cancellation of the flight FR5898 from TRN to MAD on the 28/8/2023, which was due to to UK Air Traffic Control equipment failure, outside of the control of Ryanair.As this event was outside of our control it is our opinion that we are not liable to pay Article 7 monetary compensation under EU Regulation 261/2004 in this case.EU261 requires airlines to provide the Article 14.2 notice at check-in and to distribute it during flight disruptions. In order to comply with EU261 Ryanair has provided the Article 14.2 notice when customers check in online. This gives ample opportunity prior to departure to review and have access to the notice of their rights at all times.All customers affected by this flight cancellation were sent an email and SMS giving customers access to the EU261 notice. The email contained the links to make a Free Flight Change Apply for refund, Free Phone Credit and details of how to contact our Reservations Department.In the event of a cancellation, the options available are detailed in the EU261 leaflet, as follows:1. Transport on the next available flight on the same route.2. Transport from another Ryanair departure airport or via a Ryanair airport to the original destination.3. Full Refund, once this option accepted no further liability under EU261 arises.We confirm that the claimant decided to not be re-accommodated and requested the refund which was processed back on 29/8/2023 to the form of payment used to pay for the reservation.Regarding the submitted hotel and taxi expenses, please be advised that under EU261/2004, Ryanair is neither liable to pay prepaid expenses nor expenses incurred after arrival at one's destination. Transport from another Ryanair departure airport or via a Ryanair airport to the original destination.”Faccio notare con forza che NON E’ STATO POSSIBILE CAMBIARE VOLO GRATUITAMENTE come sostenete avrei potuto fare.In fase di cambio gratuito, i voli del 29/08 da Milano e del 30/08 da Torino, entrambi su Madrid (dal costo molto pi&#249 elevato rispetto a quello cancellato!!), venivano segnalati con posti esauriti. Peccato che da un altro cellulare, sulla vostra app, si potevano acquistare. Avrei dovuto farmi rimborsare e poi pagare il triplo per volare su un di nuovo vostro volo? Era questa la soluzione che mi proponevate? Il vostro atteggiamento &#232 assolutamente scorretto. Mi sono rivolta alla Commissione Europea Consumatori ODR.
