Mancato rimborso prodotto difettoso

Spett. Primadonna S.p.A.In data 9 luglio ho acquistato presso il Vostro negozio di Quartucciu, centro commerciale le Vele, un paio di sandali pagando contestualmente l’importo di 47,99 euro. A distanza di tre settimane dall’acquisto, al secondo utilizzo, il prodotto presenta difetti che lo rendono non conforme allo scopo per cui è stato acquistato.In particolare, ha perso un pezzo importante della decorazione.Ai sensi dell’art. 130 e segg. del D.Lsg. 206/05 richiedo pertanto la risoluzione del contratto con rimborso del prezzo d’acquisto. Non richiedo un nuovo paio di scarpe o la riparazione in quanto, recatami in negozio dove ho effettuato l’acquisto, la commessa, che non ha voluto rimborsarmi, ha confermato il difetto su tutte le scarpe di quel modello, tant’è che in negozio ne aveva un paio che presentava lo stesso identico problema, quindi invendibile. In mancanza di un riscontro entro 15 giorni dal ricevimento della presente, non esiterò ad adire le vie legali a tutela dei miei diritti. Faccio seguito alla mia ultima mail, per segnalare una ulteriore assurdit&#224: oltre a non avere scarpe dello stesso modello, il buono che mi verrebbe dato &#232 spendibile entro 10 gg.! Ma stiamo scherzando! Arroganza allo stato puro! Non mi date nemmeno un congruo lasso di tempo per decidere di utilizzare il buono nel momento in cui lo ritengo necessario io! Ora, ed entro 10 gg, non trovo nulla che mi piaccia e che mi serva (perch&#233 non faccio acquisti solo per il semplice gusto di spendere, ma anche per necessit&#224), in questo caso mi dite voi cosa dovrei fare io? Prendere la prima cosa che mi capita sotto mano? Non so come ragioniate voi, ma per me sarebbe come buttare via i miei soldi! Trovate un’altra soluzione! Avete nelle vostre sedi di Milano un sandalo come quello che si &#232 rotto e mandarlo al negozio di Quartucciu?
