We are disappointed by FlixBus' continued refusal to take full responsibility for the loss of our luggage and to offer a compensation that reflects the actual value of the belongings that were mishandled and never recovered.
We were unaware about the regulation you referenced Regulation (EC) No. 1371/2007. Regardless, our request is not based on legal loopholes, but on the actual value of the lost items, which were declared in full transparency and in good faith. We are not attempting to take advantage of the situation neither inflating the value of the lost items. We are only requesting a reimbursement of what was truly lost, due to FlixBus’ failure to secure our luggage and properly manage the aftermath.
The suggested compensation of €180 is entirely inadequate because the value of the lost belongings totals approximately €1,100, as detailed in the list we previously submitted. Dismissing this amount based on assumptions such as depreciation or uncertainty about the luggage contents is unjust, particularly considering FlixBus’ lack of timely and effective action during the critical first 14 days following the incident.
To make matters worse, the driver Francesco clearly told us at the time of the incident that we would be eligible for full reimbursement and that he had reported the issue via the company’s internal group chat. We were led to believe that the case was already being handled — but it now seems we were simply being stalled without any meaningful resolution.
As it is now clear that FlixBus is unwilling to resolve this matter fairly, we will proceed with legal action. We will file formal complaints with consumer protection authorities, including the European Consumer Centre, DG JUSTICE, and other relevant national bodies. We are also consulting legal counsel to seek full compensation for the lost goods and the emotional and practical distress caused.
We regret that this issue, which could have been resolved amicably and respectfully, has come to this point due to your refusal to honor a fair and reasonable claim.
