1. Introduction
I, Roberto D'Aquino, holder of Vinted Pro account "scimmiandoshop", am filing a formal complaint regarding the permanent block of my account on 30 March 2025, which was carried out without any prior notice and in breach of Vinted's own stated procedure.
2. Seller Profile
scimmiandoshop is a legitimate business operating since 2018 in the second-hand fashion and luxury resale sector, with:
• Over 150 reviews on Vinted, all positive, not a single negative one
• Over 5,000 positive reviews across various marketplaces
• Over 70,000 followers on Instagram (@scimmiandoshop)
• Registered VAT number: IT10679850965
• Sole trader: D'Aquino Roberto, Via Giorgio de Chirico 7, 20151 Milan, Italy
• Impeccable reputation with no complaints or disputes on any marketplace
3. Disputed Facts
On 30 March 2025, Vinted permanently blocked the scimmiandoshop account, claiming to have sent a prior warning 12 days earlier. This claim is false: I never received any prior communication, neither by email nor in the account's notification history.
Vinted also accused me of:
• Selling cosmetic products – NEVER done
• Dropshipping activity – NEVER done
• Failing to remove non-compliant items by a deadline – which was never communicated
These accusations are entirely unfounded. All items sold were authentic and physically in my possession, shipped within 24 hours from Italy. This suggests that Vinted either confused my account with another user's, or that its automated moderation system made a serious error.
4. Previous Resolution Attempts
I contacted Vinted repeatedly starting from the day of the block (30 March 2025), both through the internal support system and via email to legal@vinted.it, formally contesting the block and requesting evidence of the alleged prior warning. All responses received were standardised template messages that did not address the substance of my complaint.
In particular, Vinted has never provided:
• Concrete evidence of the prior warning it claims to have sent
• A specific list of the listings considered to be in violation
• A documented explanation of the alleged violations
5. Legal Basis for This Complaint
Vinted's conduct is in breach of:
• Article 17 of the EU Digital Services Act (DSA): platforms must provide clear and specific reasons for any restriction or suspension, and allow users adequate time to remedy the situation.
• Article 20 DSA: users must have access to an effective internal complaint-handling mechanism. Vinted has repeatedly responded with automated messages without addressing the substance of the complaint.
• The principle of good faith in contractual relations: the block was applied without effective prior notice and based on undocumented accusations.
• Vinted's own Terms and Conditions: which describe a graduated procedure before any permanent block – a procedure that was not followed.
6. Formal Requests
I formally request that Vinted:
1. Immediately reinstate my Vinted Pro account "scimmiandoshop";
2. Restore all listings, reviews (150+ on Vinted, all positive) and account history;
3. Provide documented proof of the alleged prior warning sent 12 days before the block;
4. Provide the specific list of listings considered to be in violation and the reasons for each.

8. Next Steps If Unresolved
Should Vinted fail to provide a satisfactory response within 14 days, I will proceed with:
• A complaint to the European Consumer Centre (ECC Italy);
• A report to the Digital Services Coordinator under the EU DSA;
• Use of the EU Online Dispute Resolution (ODR) platform;
• Evaluation of legal action for commercial damages resulting from the unjustified block.
The economic damage is substantial: in 2025 alone, the account generated approximately €60,000 in gross sales on Vinted, all authentic products, never cosmetics or dropshipping. Vinted was a primary working tool for my business. The unjustified block has abruptly interrupted this activity, with unquantifiable loss of future earnings.
I expect this matter to be treated with the seriousness it deserves.
