Decadenza dal diritto di riscuotere penale

Data della presunta violazione 13/9/2019. Data dell'invio del sollecito 28/1/2020 ben onltre i 90 giorni previsti dall'art 8 del regolamento per cui L’omesso rispetto di tale procedura determinerà la decadenza di APCOA Parking Italia S.p.A. dal diritto di riscuotere la penale contrattuale e le ulteriori somme dovute.

Buongiorno,a seguito della Sua comunicazione, La informiamo che la prima richiesta di pagamento è stata da noi inviata con lettera prot. n. 1140/2019/HQ del 20/11/2019 rispettando i termini di 90 giorni previsti dall’ art.8 del regolamento di parcheggio.La missiva è stata inviata a mezzo posta prioritaria allo stesso indirizzo poi utilizzato dal nostro legale Avv. Non ho mai ricevuto alcuna fantomatica lettera. La prima comunicazione ricevuta da parte vostra &#232 il sollecito in data 28/1/2020 da tale avvocato Marchetti, ben onltre il termine indicato. Nuovamente quindi mi rincresce farvi notare la decadenza.
