Dear GetTransfer Legal and Customer Relations Department,
I am writing this email as a formal notice of breach of contract and an official demand for immediate refund and compensation regarding booking #22181838, made on December 5th at 18:01.
The booking concerned a bus transfer from Trieste Airport to Zagreb for 23 passengers, at the agreed and confirmed price of €462.40 (20% discounted rate).
Your platform assigned the driver Bajro Golubovic, operating a Mercedes-Benz Sprinter (2020), license plate KP-DN291, classified as Minibus 50×60, and provided the contact number +386 70 406 708. The driver’s WhatsApp profile clearly displayed the website of a Slovenian transport company (golub-travel.com), giving the reasonable expectation that the service was professional, lawful, and fully authorized.
Upon our arrival at Trieste Airport, the driver was completely unreachable, despite numerous calls and messages. Only at 17:56, minutes before the scheduled pickup, we received an SMS from another number (+386 40 759 611) stating verbatim:
"I apologize, I can't come, the police have banned me from driving in Slovenia, find other transportation. I'm sorry."
This message constitutes explicit admission that the driver assigned by GetTransfer was not legally authorized to perform the service. As a consequence, the service was entirely not provided, resulting in 23 passengers being abandoned at the airport without any assistance, alternative solution, or intervention from your platform.
Due to this gross negligence and failure in vetting and guaranteeing your service providers, we were forced to urgently secure alternative transportation through Daytrip, incurring an additional cost of €1,526.00. Furthermore, we arrived in Zagreb at 2:00 AM, suffering serious personal and professional damages, including the loss of important pre-scheduled appointments.
Given the above, GetTransfer is fully liable for:
The total non-performance of the contracted service
The foreseeable and direct damages caused by this failure
The financial losses incurred to mitigate the consequences of your breach
I therefore formally demand:
Immediate refund of the full GetTransfer booking amount (€462.40)
Full reimbursement of the replacement transportation costs (€1,526.00)
Total amount due: €1.988,40, without prejudice to any further claims.
Should this matter not be resolved within 7 calendar days from receipt of this notice, I will proceed without further warning to:
file a formal complaint with the relevant consumer protection authorities, and
initiate legal action for damages, including all additional costs and interests, for which GetTransfer will be held fully responsible.
Please confirm in writing the immediate processing of the refund and reimbursement.
