Dear Vinted Legal Team, I am writing to express my deep disappointment regarding the lack of support I received from you following the purchase of a counterfeit item on your marketplace. On 26/03/2024, I purchased a pair of AirPods 3 from seller Junskooo through your website. However, upon receiving the items, I immediately noticed several elements that clearly indicated their counterfeit nature. Among these, I highlight: 1) The presence of a single serial number on both the headphones and the case, contrary to Apple's specifications, which require different serial numbers. 2) The claim of "MagSafe charging" on the box, while the headphones were Lightning charging, as also confirmed by Apple's official website through the serial number entry. 3) The absence of any Apple branding on the charging cable, despite the manufacturer's website specifying several symbols that should be present in originals. 4) Various details, including logos, instructions, and font, were different from the originals, which I possess. I promptly filed a complaint regarding this situation, however, I was informed that there were not enough reasons to consider the items counterfeit. This not only ignores clear evidence of counterfeiting but also leaves me vulnerable to being accused by the fraudulent seller, jeopardizing my right to a refund. In order to obtain official confirmation of the counterfeiting, I have booked an appointment at an Apple Store for 11/04/2024, during which the items has been certified as fake (see attachment). I expect Vinted to support my refund request, in accordance with your policy (shared on your website) that provides for refunds for counterfeit items. I want to emphasize that if Vinted does not recognize the counterfeit nature of the items, it will become complicit in the fraud committed by the seller. This behavior not only damages my trust in your service but also highlights a lack of integrity in ensuring the safety and fairness of transactions made on your platform. I am deeply disappointed by your lack of support in this situation and reserve the right to take further legal action if an adequate response and full refund are not provided.
